FilterForVisitor.Filter() in EPiServer 7 shows empty result?

FilterForVisitor has a new behaviour in EPiServer 7

Even though your pages have Read access and also are Published, the list can be empty.

I found out that it was relating to the fact that the actual page did not have a .aspx file connected to the pagetype.

So after I created the aspx page the Filter works well again.

This is not a logical behaviour .....
